1. What this addendum covers

This addendum explains how payments, Smart Escrow, payouts, refunds and fees work when you pay or get paid through P3RSON. It adds to the Terms of Service, Sections 3.2, 3.4 and 3.8. If this addendum and the Terms differ on these topics, this addendum applies.

It applies to creators, talent, agencies and brands. It does not apply to P3 Pro or P3 Coin purchases made through Apple (see the P3 Pro and Coins Addendum) or to Agency and Brand plan billing (see the Agency and Brand Addendum).

To get paid, you must connect a Stripe Connect Express account in the app.

Suspension. P3RSON may suspend payouts for fraud or suspected fraud, failed identity checks, violations of the Terms or Stripe's terms, or three or more chargebacks or payment failures in 90 days. We give 30 days' written notice, except in severe cases such as fraud or legal requirement.

Worked example: booking with an agency

The agency commission is calculated on the amount left after the platform fee, not on the gross amount. On a $100 booking: the platform fee is $10.00, the agency's 20% is $18.00 (20% of $90), and the talent receives $72.00. The Stripe fee, which the creator side bears under the booking record, is deducted from the creator side's amount. See the Agency and Brand Addendum.

5. How Smart Escrow works

  1. A brand books a creator. The brand pays by card. Stripe collects and holds the payment.
  2. The creator confirms and delivers the work.
  3. P3RSON instructs Stripe to release the funds when one of the triggers in Section 6 happens.
  4. Stripe transfers the creator's share to the creator's Stripe account. The platform fee, and any agency commission, are split off at the same time.

The split happens as a single instruction. If any part fails, none of it is applied, and P3RSON retries it safely without double payment.

6. Release triggers

Funds are released when:

  1. the brand marks the delivery approved;
  2. the review period stated in the booking contract ends and no dispute is open (automatic release); or
  3. a dispute is resolved in favor of release.

7. Hold period: up to 90 days

P3RSON may hold funds for up to 90 days from the day the booking is funded. This is P3RSON's right, not an automatic system guarantee, and P3RSON may release, return or extend a hold as described here.

Booking and payment disputes follow the schedule in one place, the Dispute Resolution policy, Section 4:

10. Chargebacks

A chargeback happens when a cardholder disputes a payment with their card issuer. P3RSON may defend the payment for the account holder by giving Stripe the booking record, messages and proof of delivery. The creator is responsible for keeping their own proof, and P3RSON does not always decide in the creator's favor.

P3RSON may withhold or reverse payouts, fees and P3 Coin value for fraud, chargebacks, policy violations or legal requirement. P3RSON may recover any negative balance from future payouts.

11. Negative balances

A balance goes negative when a refund, chargeback, reversal or fee is larger than the funds still owed to you. You owe that amount. P3RSON may deduct it from future payouts, and Stripe may collect it from your connected bank account under its agreement with you.
