About this addendum
This addendum adds to the Terms of Service and the Privacy Policy for agencies, agents and brands (clients). Part A sets the commercial and representation terms. Part B is the privacy rider for agency data. If this addendum and the Terms or Privacy Policy differ for agency accounts, this addendum applies.
Part A: Commercial and representation terms
A1. The Agency and Brand plan
| Item | Terms |
|---|---|
| Price | $100.00 per month (USD), including one admin seat |
| Additional seats | $10.00 per month per seat |
| Billing | Through Stripe, outside the App Store, as an organization (business) subscription |
| Activation | On the first successful payment |
| Renewal | Monthly, on the anniversary of activation, until cancelled |
Seat examples:
| Seats | Monthly price |
|---|---|
| 1 | $100 |
| 3 | $120 |
| 5 | $140 |
| 10 | $190 |
The plan is separate from P3 Pro. P3 Pro is a personal subscription bought through Apple. The plan is available from the date the app or web account shows it as available to you.
A2. Seats
- The admin can add or remove team members up to the number of paid seats.
- Seat additions are prorated for the rest of the current period and charged on the next invoice.
- Seat removal takes effect at the next renewal. A downgrade is credited to a future invoice.
- There is no cash refund for a partial month, except as required by law.
- Agent roles (Admin, Editor, Scout) are described in Section A5.
A3. Payment, renewal and cancellation
- Payment method. Your card on file is charged automatically each month.
- Payment failure. We retry the charge and notify you. You have a 7-day grace period. If the invoice is still unpaid after 14 days, the account is suspended and agency functions are disabled. Updating your payment method and paying the invoice restores access.
- Cancellation. You can cancel any time in the web account (Billing, one step). There is no cancellation fee. The plan stays active until the end of the paid period.
- Reminders and price changes. We email a renewal reminder at least once a year for any annual plan, if one is ever offered. We email you at least 30 days before any price increase takes effect.
- Receipts. Invoices are in the web account under Billing.
A4. Commission, platform fee and payouts
- P3RSON deducts the 10% platform fee from the gross booking amount first.
- The agency commission is calculated on the amount left after the platform fee, not on the gross amount.
- The Stripe processing fee (2.9% + $0.30) is paid by the creator side and is stated in the booking record.
- P3 Coins gifts carry a separate 20% platform fee and never fund bookings. Any agency commission on a tip applies to the talent's share only.
Example: a $100 booking.
| Line | Amount |
|---|---|
| Gross booking | $100.00 |
| Platform fee (10%) | -$10.00 |
| Left after the platform fee | $90.00 |
| Agency commission (20% of $90) | $18.00 |
| Talent share | $72.00 |
The talent share is before the Stripe fee. The booking confirmation shows the talent the gross amount, the platform fee, the agency commission percentage and the projected net before the talent confirms.
Booking funds are held by Stripe and released as described in the Stripe Connect Addendum. Commissions are paid to the agency's Stripe account 3 to 5 business days after release. The agency commission is paid only if the funds are released to the talent.
A5. Representing talent
What agencies must do:
- Act in good faith and in the talent's best interest.
- Keep talent profiles accurate and talent information confidential.
- Tell talent their commission and any other deduction in writing, with the payment schedule.
- Give talent access to their booking history and earnings.
- Not stop talent from contacting P3RSON or using their own profile.
- Not misrepresent a talent's capabilities, rates or availability.
- Not sell, license or use talent data outside the booking context.
- Not delay or withhold talent payments without documented cause.
Talent rights:
- Talent own their profile, images and data. Agencies are representatives only.
- Talent can remove an agency at any time, with or without cause. Talent keep all profile data, images and booking history, and take over their own profile immediately. Pending bookings and disputes continue.
- Talent can accept or decline bookings, and can dispute a booking directly with P3RSON.
- Talent can ask for the log of agent access to their profile (Section B5).
- Members under 18 cannot be represented for monetized activity. There are no bookings, payouts, coins or subscriptions for minors.
Agent roles:
| Role | Can do | Cannot do |
|---|---|---|
| Admin | Full access to agency settings, divisions, talent profiles, billing and seats; approve client access; invite and remove agents | Hide actions from the activity log |
| Editor | View and edit assigned talent profiles; manage divisions; answer client access requests | Change billing; remove agents; see talent earnings or tax information |
| Scout | View assigned talent profiles (read-only); search and filter | Edit anything; answer client requests; see earnings or financial data |
Each agent can access only the talent assigned to them, unless the agency gives the agent all-talent access. Every action is logged.
A6. Talent Book and client access
The Talent Book is a set of talent profiles organized into divisions. Agencies control which clients see which division. A client request is at one of four levels:
| Level | Meaning |
|---|---|
| Pending | Requested, not decided. The agency has 7 days to approve, deny or ask for more information. The client sees no talent. |
| No Access | Denied. The client can reapply after 30 days. |
| Cover Only | The client sees featured talent only, with limited profile information. |
| Entire Book | The client sees all talent in the division and can message and book them. |
Clients may see photos, bio, rates, availability, content samples and the agency's contact details. Clients may not see talent earnings, tax or financial data, personal contact details, other divisions, or agent names.
Clients agree to:
- keep talent information confidential and not share their access;
- not screenshot or export profiles for resale;
- not use the Talent Book to recruit talent off-platform or to avoid fees.
The agency can revoke client access at any time, effective immediately. Pending bookings continue as agreed. P3RSON may also revoke access for misuse, off-platform booking to avoid fees, or a violation of the Community Guidelines.
A7. Booking disputes involving an agency
Disputes follow the Dispute Resolution policy, Section 4. The agency may help, but cannot decide for the talent. P3RSON asks the talent directly about whether the work was completed. Agency commission is deducted only if funds are released to the talent. If an agency does not respond in a dispute, P3RSON works directly with the talent.
Part B: Privacy rider for agency data
This part adds to the Privacy Policy. The Privacy Policy covers everything not stated here.
B1. Roles
- For agency staff, agency account details and billing, P3RSON is the business that decides how the data is used.
- For talent data that an agency adds about talent it represents, the agency decides why it is used and is responsible for having the right to add it. P3RSON handles that data to run the service.
- Brands and clients who receive talent information through the Talent Book must use it only as this addendum allows.
B2. Data we collect from agencies and agents
| Category | Examples |
|---|---|
| Agency account | Business name, registration details, principal's name, business email, phone and mailing address, tax ID for tax reporting |
| Billing | Plan, seat count, invoices, payment status. Card details are held by Stripe. |
| Agent | Name, email, phone, role, assigned talent, optional photo, sign-in details, device information, last sign-in time |
| Agency settings | Language, country, time zone, divisions, commission and rate settings |
| Activity log | Agent ID, action, time, fields changed and objects touched, for sign-ins, edits, approvals and Talent Book changes |
| Client activity | Access requests, permission changes, profiles viewed, messages sent, bookings made |
B3. Talent data
- Talent own their personal information and content, whether or not an agency represents them.
- Agents see talent data only as their role allows (Section A5). Attempts to open data outside a role are blocked and logged. Misuse leads to removal of access.
- Talent earnings and tax information are visible to Admin agents only. Editors and Scouts cannot see them.
- Digitals, audit results and AI Scout Notes stay private to the talent unless the talent chooses to share them with their agency. An agency sponsoring an Audit does not receive the images or notes unless the talent shares them.
- Agencies must not share talent contact details with third parties without the talent's consent.
When a talent removes an agency, the agency's access ends. The agency must give the talent a final accounting of earnings and commissions and must delete the talent's data it holds outside P3RSON on request. P3RSON removes the agency's agent access to that talent immediately.
B4. Security
- Access is limited by role and by assigned talent.
- Data is encrypted in transit and at rest.
- Agents with Admin or Editor roles may be asked to use Face ID, Touch ID or a passcode on their own device. Biometric checks happen on the device only. P3RSON receives only an approved or denied result.
- Agencies must keep sign-in credentials private and must not share accounts. Each person needs their own seat.
- Report a security problem to [email protected].
B5. Talent audit and export
Talent can ask for:
- the log of agent access to their profile for the past 12 months, showing agent name, role, action and time;
- an export of their data in CSV or JSON.
We answer within the time in Section B7. Requests go to [email protected] or are made in the app.
B6. Retention
| Data | Kept |
|---|---|
| Agent credentials | While the agent is active, then 90 days after removal |
| Activity log and client permission history | 5 years |
| Agency settings | Until the agency account is deleted |
| Booking, payment and invoice records | 7 years |
| Talent profile content | Until the talent deletes it or deletes their account |
| Digitals and audit results | Under the biometric retention schedule in the Privacy Policy and the Data Retention Policy |
Records we must keep by law stay after account deletion.
B7. Your requests
You can ask to see, correct, delete or export your data, to opt out of sale or sharing (P3RSON does not sell personal information), and to limit use of sensitive information. Write to [email protected], or to [email protected] for California requests, or to [email protected] for biometric and sensitive-data requests. Mail: Secundino Fulgencio, P3RSON, Inc., P.O. Box 6178, Astoria, NY 11106, USA. We respond within 45 days and may extend once by up to 45 more days with notice. You can appeal a decision by replying to our response.
P3RSON offers the service in the United States and does not offer it to users in the EU, EEA or UK.
