Biometric and Sensitive Data Notice

Version: 5.0.0
Effective Date: October 2, 2026
Last Updated: October 2, 2026
Suite: P3RSON Legal Suite 5.0.0

1. Why You Are Seeing This

Your Digitals are photos of your body and face. Some laws treat information about the body and face as sensitive, and some treat biometric data in a special way. P3RSON, Inc. ("P3RSON", "we", "us") gives you this notice and asks for your written consent before we analyze your photos.

2. What Image Analysis Does

When you submit Digitals, or use Digital Snap, we run them through AI services (see the AI Features Notice):

3. What It Does Not Do

4. What We Store

We store your original Digitals in P3RSON cloud storage, and, with your audit record: your presentation readiness score, per-photo quality checks, private AI Scout Notes, reason codes, moderation flags, and the face-count, confidence, brightness, and sharpness values.

5. Retention and Destruction Schedule

A "last interaction" means the last time you signed in or used your account.

We ask for your consent at the point of capture, before your first Digitals photo is analyzed. The consent screen has its own checkbox, unchecked by default. Tapping the checkbox and Continue counts as your written release and electronic signature. This consent is separate from accepting the Terms and the Privacy Policy, and separate from the AI photo analysis consent in the AI Features Notice.

If you decline, you can keep using every non-AI feature.

7. No Sale, No Advertising

We never sell, lease, or trade biometric identifiers or other data from your photos. We never use them for advertising or to profile you for marketing.

8. Who Sees Your Results

You do. Results are private unless you choose to share them. For members under 18, only the member and the verified guardian can see them. Brands and agencies do not see audit results.

9. Security

We encrypt photos and results in transit and at rest, limit staff access to those who need it for support or safety, and oversee our providers. See the Privacy Policy for more on security.

10. State Laws

This notice is meant to satisfy notice and consent duties under laws such as the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier law, Washington's biometric and My Health My Data laws, Colorado's biometric amendments, and the sensitive personal information rules of the California Consumer Privacy Act as amended. P3RSON is offered in the United States only.
