IP Policy

1. Purpose

This policy covers copyright, trademarks, brand and identity protection, and P3RSON's own intellectual property. It works with the Terms of Service, Creator Rights, the DMCA Policy, the Copyright Guide and the Image Rights Addendum.

2.1 Your Content

You own the content you create and post. You give P3RSON only the license described in the Terms of Service and Creator Rights, to host, display and deliver your content on the platform. Brands and agencies receive usage rights only as stated in the booking contract.

2.2 Other People's Content

Do not post, copy, republish or sell content you do not own or have permission to use. Do not claim someone else's work as yours. Do not repost content to other platforms or use it commercially without the owner's permission.

2.3 Fair Use

Some uses are allowed without permission under U.S. fair use law, such as commentary, criticism, news reporting, teaching and parody. Fair use depends on the facts: the purpose of the use, the nature of the work, how much is used, and the effect on the market for the original. We do not decide fair use. If a member says a removed item was fair use, they may send a counter-notice.

Report infringement through the DMCA Policy and the DMCA Notice page. We remove material within 24 hours of a valid notice, tell the member, and allow a counter-notice. Three valid takedowns lead to a 7-day suspension. The fourth leads to termination, in line with the Terms of Service, Section 5.4.

3. Trademarks, Brand and Impersonation

3.1 P3RSON Marks

"P3RSON", the "p3" monogram, and related logos and names belong to P3RSON, Inc. You may not use them in a way that suggests we sponsor or endorse you. You may state the plain fact that you use P3RSON.

3.2 Third-Party Marks

Do not use another person's or brand's name, logo or distinctive mark:

Honest, factual references are allowed, such as naming a brand you worked with, reviewing a product, or commenting.

3.3 Impersonation

Do not pretend to be a person, brand, agency or P3RSON staff member. Do not use someone else's name, photo or likeness to make an account or post as them. Parody accounts must say they are parody in the display name and bio.

3.4 Reporting Trademark Misuse or Impersonation

We review the report and may remove content, rename or restrict an account, or ask for more information. We tell the member and allow an appeal under the Appeals process. We may act without a report when misuse is clear.

4. No AI Training on Member Content

P3RSON does not use member photos, video, audio, messages or other content to train generative AI or recognition models. Our instructions to AI providers say not to train on member content, and we do not give providers permission to do so. Providers may keep inputs briefly for their own safety and abuse monitoring under their commercial terms. See the AI Features Notice for details.

You may not scrape P3RSON or use content on P3RSON to train AI models without written permission from the content owner and from us.

No one may create or use a digital replica or AI likeness of a person without that person's separate written approval that describes the intended use. This applies to members, brands and agencies. See the Image Rights Addendum.

5. P3RSON's Intellectual Property

The P3RSON app, software, design, text, graphics, audits, scoring methods and data compilations belong to P3RSON, Inc. or its licensors. You get a limited, personal, revocable license to use the app as the Terms of Service allow.

You may not:

Security researchers who report a vulnerability in good faith should send findings to [email protected].

6. Feedback

If you send us ideas or suggestions, we may use them without owing you payment or credit. This does not apply to your own content.

7. Disputes About Ownership

If you think a takedown, an account action or a claim is wrong, you have these routes:

DisputeRoute
Copyright takedown of your contentDMCA counter-notice
Brand claim against your handle or contentReply to the notice; email [email protected] with proof of your rights
Another action on your accountAppeals process

We do not decide ownership between members. We act on valid notices and follow the DMCA process, and courts decide ownership.

8. Users Outside the United States

You may access the app from elsewhere only at your own risk and you are responsible for following your local laws. U.S. law governs this policy. P3RSON makes no representation that the service is appropriate or lawful outside the United States.
