1. What This Addendum Covers
This addendum explains who owns the images you put on P3RSON, what we may do with them, how images are analyzed, and what protections apply to people who appear in them. It adds to the Terms of Service, Creator Rights, the Privacy Policy and the Guardian and COPPA document. If it conflicts with those on image rights, this addendum controls.
Images means photos, Digitals (the four required photos used for the P3 Audit), portfolio images, profile photos, video frames and anything else showing a person.
Two other documents give detail:
- The AI Features Notice explains how AI tools read your images.
- The Biometric and Sensitive Data Notice explains biometric and sensitive-data rules and your rights.
2. Ownership
You keep ownership of your images and of any copyright you hold in them. P3RSON claims no ownership of them.
If someone else took the photo, they usually own the copyright. You need their written permission before you post it. A credit line is not permission.
P3RSON owns the app, its software, scoring methods and design, and statistics that do not identify you.
3. License You Give Us
When you upload an image, you give P3RSON a non-exclusive, worldwide, royalty-free license, for as long as the image stays on your account, to:
- store, copy, resize, compress, format and watermark the image
- display it where your visibility settings allow
- process it for safety checks and for features you use
- deliver it to people you choose, such as a brand or agency you apply to
This license ends when you delete the image or your account, except for the retention periods in the Data Retention document, and for copies others already received under a booking contract.
We do not use your images in advertising, email marketing, social posts, press materials, case studies or testimonials without your separate written permission. We do not sell or license your images to third parties.
4. Your Promises About Images
When you upload an image, you promise that:
- you own it or have the right to post it
- every identifiable person in it has agreed, in writing where required, to appear and to the way it will be used
- no one under 18 appears unless a parent or guardian has agreed and the Guardian and COPPA rules allow it
- it is not a deepfake or synthetic image of a real person made without that person's approval, and it does not impersonate anyone
- it is not an intimate image of anyone without that person's consent
5. Who Controls Visibility
You choose who sees your images.

Changing a setting takes effect for new views right away. Anyone who already saved or copied an image keeps their copy. Private Digitals and audit results are not shown to other members unless you share them.
6. Watermarks
Portfolio images may carry a watermark showing your P3RSON name or ID, to help show where an image came from. You may ask for a copy without the watermark in Settings, and use it for your own work, including with agencies and brands. Removing a watermark from someone else's image is not allowed.
7. Releases and Likeness
7.1 Model and Property Releases
If a person appears in your image and you will use it in a booking or for a brand, get a release signed by that person. The release should say how and where the image may be used, for how long, and whether it covers edits. Keep a copy. We may ask to see it.
7.2 Likeness in Bookings
A booking contract gives a brand or agency only the likeness rights it lists. Unless the contract says otherwise, no one may:
- use a member's image or likeness outside the booked channels or term
- edit an image in a way that changes the person's identity, body or meaning
- use a member's image to imply endorsement of something not in the booking
7.3 No Digital Replicas Without Separate Approval
No digital replica or AI likeness of a person may be created or used without that person's separate written approval that describes the intended use. This applies to brands, agencies and members. A booking contract, a general release or consent to the Terms of Service does not count as that approval. The approval must name the use, such as the campaign, the channels and the time period, and the person may withdraw it for future uses.
A digital replica means a computer-generated or AI-generated voice, face, body or other likeness that looks or sounds like a real, identifiable person. We remove replicas made without approval, and may suspend or terminate the account that made or used them.
7.4 State Publicity Laws
Many states, including California, protect a person's name, voice and likeness from unauthorized commercial use. P3RSON follows these laws. If you think your likeness was used without permission, report it to [email protected] or send a copyright notice if you own the image.
8. Minors
Members aged 13 to 17 are read-only by default. Posting images and using the private P3 Audit require active guardian approval, and the third-party AI disclosure for the audit needs separate guardian consent. Minors cannot use bookings, P3 Coins, tips, subscriptions or payouts, and their images are not used for commercial publishing or name, image and likeness deals.
No one may post images of a person under 18 for commercial use. We do not disclose a minor's images to third parties for advertising or marketing. Minors' images go to an AI provider only for the private P3 Audit, after separate guardian consent.

Images showing sexual content involving a person under 18 are removed at once, reported to the National Center for Missing and Exploited Children as the law requires, and the account is terminated.
9. How We Analyze Images
9.1 What Happens
Only verified adults who accepted the current Privacy Policy and gave separate, opt-in consent can use AI image features. Consent is asked for at the point of capture, before your first Digitals image leaves your device. Declining keeps every non-AI feature working. You can withdraw in Settings, Privacy, AI Photo Analysis.

The instruction to the AI forbids inferring age, gender, race, skin tone, emotion, attractiveness, identity or health, including skin conditions. We do not use face comparison, face search or face indexing for the private Audit, and we do not create or store face templates, faceprints or face geometry. Digital Snap is limited to 25 analyses per member per day.
9.3 What We Store
With your audit record we store the presentation-readiness score, per-photo quality checks (lighting, sharpness and framing flags), private scout notes labelled as AI-generated, reason codes, moderation flags, and the face count, confidence, brightness and sharpness values. Your original images stay in P3RSON cloud storage until you delete them or your account.
9.4 What the Output Means
AI output is coaching. It is not a decision about eligibility, hiring, credit, housing or pricing, and not a prediction about a person. A person can review any result on request at [email protected]. Providers may keep inputs briefly for their own safety and abuse monitoring under their commercial terms. They process images in the United States.
9.5 Not Used for Marketing or Identification
We do not use your images, or anything derived from them, to identify you to others, to rank you publicly, or for advertising. Biometric identifiers are never sold, leased, traded or used for advertising.
10. No AI Training
P3RSON does not use your images to train generative or recognition models. Our instruction to providers is that they must not train on them, and the provider terms that apply to our API use say the same. We do not allow anyone else to scrape images from P3RSON to train a model.
11. Retention and Deletion

Account deletion triggers deletion of your Digitals and audit results within 30 days, and of backups within a further 30 days. Provider-side copies are handled under the providers' terms.
To delete an image or all your images, use Settings. To ask us to do it, email [email protected]. We may keep an image longer where a legal hold, a dispute, a legal duty or a safety report requires it, and only for that purpose.
Deleting an image from P3RSON does not remove copies other people already saved, or copies a brand holds under a booking contract. Ask the brand to delete them or invoke the booking contract.
12. State Laws
We follow the biometric and sensitive-data laws that apply to U.S. residents. These include the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier law, Washington's biometric and My Health My Data laws, Colorado's biometric amendments, and the sensitive personal information rules of the California Consumer Privacy Act as amended. 13. Reporting Misuse of Images

14. Disputes
Disputes between members about image rights go through the Dispute Resolution process. We do not decide who owns an image. Disputes with P3RSON follow the Terms of Service.
15. Changes
If we make a material change to this addendum, we ask you to accept the new version before you continue. Other changes take effect when posted.
